Introduction & Acceptance of Terms

Welcome to Lucky Little Poppy ("we," "our," "us," or the "Platform"). Lucky Little Poppy is an Australian grassroots mutual aid and community relief network dedicated to easing cost-of-living pressure for everyday Australian individuals and families through collective funding, emergency relief disbursements, peer-to-peer equipment sharing, and reciprocal community care.

By accessing or browsing our website (luckylittlepoppy.com), creating a member account, contributing financial membership dues, requesting items from the Library of Necessity, or submitting a Pay It Forward nomination, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service & Community Charter ("Terms") in full.

If you do not agree to these Terms, you must not access the Platform or participate in its community initiatives.

Community Charter & Conduct Principles

"In a world so quick to cut tall poppies down, we're here to help the little ones grow."

Our foundational charter is built on empathy, dignity, radical transparency, and mateship.

To maintain a safe, welcoming, and high-trust environment for all participants across Australia, members agree to adhere to the following standards of conduct:

  • Integrity & Honesty: Provide truthful and accurate information when requesting emergency relief, nominating mates for hardship support, or requesting tools.
  • Respect & Dignity: Treat all community members, nominees, and support curators with kindness, civility, and respect. Harassment, abusive language, discrimination, or bad-faith interactions will result in immediate permanent account termination.
  • Non-Commercial Use: Platform resources, community loan equipment, and relief disbursements must not be exploited for commercial profit, unauthorized resale, or third-party syndication.

Membership Tiers & Financial Contributions

Lucky Little Poppy offers voluntary financial membership tiers designed to sustainably power our community initiatives:

Monthly Founding Poppy

$10 AUD / month

Recurring monthly contribution underwriting ongoing community relief and tool logistics.

Annual Foundation Seed

Yearly Founding Poppy

$100 AUD / year

Annual commitment to seed the grassroots relief pool and sustain long-term community operations.

Open Books Blueprint: Every $10 equivalent contributed is distributed under our published 100% transparent formula: 55% direct community relief grants, 20% logistics & postage for tool sharing, 15% platform management & administration, 5% direct grassroots Australian charity donations, and 5% emergency buffer reserves.

All prices are quoted in Australian Dollars (AUD) and are inclusive of any applicable Goods and Services Tax (GST).

Incidental Community Reward Draws

Australian Trade Promotion Compliance Notice: Reward draws conducted by Lucky Little Poppy are incidental member perks operated in compliance with applicable Australian state and territory trade promotion gaming frameworks.

1. Incidental Member Benefit: Periodic rewards (such as grocery vouchers, fuel cards, utility credits, and workshop equipment) are provided free of charge as an incidental appreciation benefit for active financial members. The Platform does not sell lottery tickets, raffle entries, or gambling products.

2. Equal Entry (1 Member = 1 Ticket): Every active, financial member receives exactly one (1) entry into applicable reward draws during each eligible period. Additional tickets cannot be purchased; there are no pay-to-win tiers or volume multipliers.

3. Eligibility: Entry is open strictly to permanent residents of Australia aged 18 years or older who hold an active, non-paused, non-canceled subscription at the time of draw execution. Paused or canceled memberships are not eligible to enter or win active draws.

4. Activation Milestone: Reward draws commence upon official platform launch once foundational subscriber milestones are reached.

5. Verifiable Random Draw: Winning entries are selected at random using a verifiable, cryptographically secure pseudo-random number generator (PRNG) ensuring complete impartiality and equal chance of selection for all active members.

6. Notification & 90-Day Statutory Claim Window: Winners will be notified via registered email and their Member Dashboard within forty-eight (48) hours of selection. In strict accordance with Australian trade promotion standards, winners have a 90-day (ninety-day) statutory claim window from the date of notification to claim their prize.

7. Redraw Procedure: If a prize remains unclaimed after the 90-day claim period despite reasonable contact attempts, an official redraw will be executed under identical conditions to award the prize to another eligible active member.

8. Statutory Harmonization: Draws are structured in compliance with the Community Gaming Act 2018 (NSW) & Community Gaming Regulation 2020, the Gambling Regulation Act 2003 (Vic), the Charitable and Non-Profit Gaming Act 1999 (Qld), and equivalent legislation across South Australia, Western Australia, the ACT, Tasmania, and the Northern Territory.

Library of Necessity — Tool & Equipment Loans

The Library of Necessity provides active members with free postal access to high-utility diagnostic scanners, tools, and specialty devices across Australia:

  • 14-Day Loan Period: Members may borrow items for up to fourteen (14) consecutive calendar days from delivery to complete their DIY tasks or vehicle troubleshooting.
  • Prepaid Return Satchel: Every item is dispatched with an included prepaid Australia Post return satchel. Borrowers agree to safely repackage the item and lodge it at an Australia Post outlet upon completion.
  • DIY Informational Disclaimer ("As-Is"): Diagnostic tools (such as OBD2 scanners) provide informational readout data only. Lucky Little Poppy does not provide licensed mechanical, electrical, or engineering advice. Members assume sole responsibility for the operational safety of their vehicles and equipment.
  • Compassion Clause: Normal wear-and-tear is accepted with empathy. Members experiencing unexpected delays or accidental issues can request an extension under our Compassion Clause. Willful withholding, intentional destruction, or unauthorized resale of community equipment will result in immediate membership revocation and recovery actions.

Pay It Forward — Grassroots Hardship Relief Nominations

Active members may submit Pay It Forward nominations to direct emergency assistance (such as grocery vouchers, utility bill credits, or essentials) to Australian mates, family members, or neighbors facing severe financial strain.

Discretionary Mutual Aid Pool: All relief disbursements are funded directly from the community relief pool (55% allocation). Disbursements are discretionary community mutual aid grants rather than commercial insurance policies, contractual guarantees, or financial entitlements. Allocations depend upon available pool liquidity and community curation.

Nominee Privacy & Dignity: Nominees' identifying information is treated with strict confidentiality. Relief is delivered with dignity and zero public exposure.

Australian Consumer Law (ACL) & Limitation of Liability

Statutory Consumer Guarantees: Our services come with non-excludable guarantees under Schedule 2 of the Competition and Consumer Act 2010 (Cth) (the Australian Consumer Law or "ACL"). Nothing in these Terms excludes, restricts, or modifies any statutory rights, remedies, or guarantees that cannot lawfully be excluded under the ACL.

Permitted Remedy Limitations (s 64A ACL): To the extent permitted under section 64A of the ACL, our liability for failure to comply with a consumer guarantee (other than a guarantee under section 51, 52, or 53) is limited strictly at our election to:

  • The resupply of the services; or
  • The payment of the cost of having the services supplied again; or
  • A refund of the actual subscription membership dues paid for the relevant period.

Exclusion of Consequential Loss: To the maximum extent permitted by applicable Australian law, Lucky Little Poppy is not liable for indirect, incidental, special, or consequential loss or damage, loss of profits, loss of data, vehicle mechanical failure, or personal inconvenience arising out of or in connection with the Platform or tool usage.

Cancellations, Pauses & Compassion Refunds

1-Click Self-Service Cancellation: You may cancel your subscription at any time with zero penalties, lock-in contracts, or cancellation fees directly via your Member Dashboard or the Stripe Customer Portal. Upon cancellation, your membership remains active until the end of your current paid billing period.

Pause Helping Feature: If you are navigating personal financial hardship, you can pause your contributions in your Dashboard with a single toggle. Pausing stops recurring billing immediately while keeping your account intact for when you're ready to resume.

Compassion Refund Policy: We understand that circumstances change. If you were charged unintentionally, experienced severe financial hardship, or were unsatisfied with the platform within fourteen (14) days of billing, contact our support team for a swift, compassionate refund review.

Privacy, Security & Data Handling

Lucky Little Poppy complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs):

  • Identity & Authentication: User accounts, sessions, and authentication security are powered by Clerk.
  • Payment Security: Financial transactions are processed via Stripe using encrypted Level 1 PCI-DSS certified payment infrastructure. Lucky Little Poppy does not store, process, or transmit raw credit card numbers on its servers.
  • Address & Delivery Data: Postal addresses submitted for Library of Necessity tool loans or Pay It Forward relief care packages are used solely to fulfill the requested logistics and are never sold, rented, or commercialized.

Governing Law & Jurisdiction

These Terms are governed by, and construed in accordance with, the laws of the Commonwealth of Australia and the State of New South Wales (or your Australian state or territory of residence where required by mandatory consumer protection legislation).

Both you and Lucky Little Poppy submit to the non-exclusive jurisdiction of the courts of Australia and the relevant State/Territory tribunals for the resolution of any disputes arising under these Terms.
